Mendham Borough’s Affordable Housing Obligations

Mendham Borough is currently facing a Fourth-Round affordable housing obligation of 124 units, ongoing litigation, and several developer-driven proposals advancing on sites within the community. While the state mandate presents challenges for many New Jersey municipalities, the extent to which these pressures now shape local outcomes reflects years of largely reactive rather than strategic planning.
Other towns began preparing earlier by engaging stakeholders, securing land, and exploring preservation tools. In Mendham, limited early action in these areas has left the Borough with fewer options and greater reliance on defending against proposals designed primarily by developers.
During my twelve years as Mayor, many municipalities across New Jersey were operating in a holding pattern as the state lacked a clearly functioning affordable housing enforcement framework. During that period, Mendham Borough took proactive steps to position itself thoughtfully for the future rather than waiting for outside pressures to dictate outcomes.
It was during this time that efforts were advanced, with the help of Mike Zedalis as the Chair of the Historic Preservation Committee, to expand and strengthen the Borough’s Historic District protections, helping safeguard key areas of the community from inappropriate overdevelopment and reinforcing Mendham’s commitment to preserving its historic character and small-town identity.
Key Areas Where Earlier Action, If Taken, Could Have Strengthened Local Control
Engagement with Developers
Proactive dialogue with potential developers can help shape project designs, densities, and site plans to better align with a community’s character and scale. When municipalities engage early, they are better positioned to negotiate outcomes rather than responding primarily through litigation after plans are submitted.
Land Acquisition Strategy
Acquiring suitable parcels using tools such as the NJ Affordable Housing Trust Fund, Green Acres grants, open space funding, and bonding authority gives municipalities greater control over location, design, and unit types. Borough-owned land allows for tailored solutions, such as senior and disabled housing, that meet obligations while fitting the community’s context. Earlier pursuit of these opportunities would have expanded Mendham’s options.
Farmland and Open Space Preservation
State and county programs exist to support permanent preservation of farmland and open space, often with significant external funding. Designating vulnerable parcels through these programs can help protect community character while directing development toward more appropriate locations. Greater early focus on these tools would have reduced exposure of key sites.
Communication with Residents
Clear, ongoing communication helps residents understand the requirements of the mandate, available options, and municipal decisions. Timely updates from Borough officials allow for informed community input rather than reliance on external sources.
A Forward-Looking Approach
Henry, Murphy, and Zedalis for Mendham will prioritize proactive strategies from day one:
• Open direct, constructive dialogue with developers to negotiate designs and plans that respect Mendham’s scale and character.
• Pursue an active land acquisition program leveraging available grants and trust funds to minimize taxpayer costs while gaining control over implementation.
• Advance farmland and open space preservation on appropriate parcels.
• Develop Borough-controlled sites for senior, disabled, and other qualifying affordable housing that meets obligations while fitting community needs.
• Maintain regular, transparent communication with residents throughout the process.
Effective management of affordable housing obligations requires foresight, strategic use of available tools, and a commitment to guiding outcomes rather than responding to them.
